Welcome to GlobalBuy24 ("GB24"). These Terms of Service (“Terms”) govern your access to and use of the GlobalBuy24 mobile application (“App”) and its associated services. By using our platform, you agree to comply with these Terms. If you disagree, you must discontinue using the app and services.

1. Description of Services

GlobalBuy24 is an innovative e-commerce facilitation platform designed to bridge the gap between users in underserved markets and global online retailers. Our mission is to empower users by providing access to a wide range of products from international e-commerce websites and ensuring a streamlined shopping experience.

  • GB24 is not a seller; we facilitate purchases from third-party online stores.
  • Orders are shipped from our hub in Berlin, Germany to selected African destinations.
  • Users must ensure their chosen items can be delivered to our Berlin hub before placing an order.

2. Acceptance of Terms

By downloading, installing, or using the GlobalBuy24 App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must stop using the App immediately.

3. Changes to Terms

GlobalBuy24 reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon posting within the App or through other notifications. Your continued use of the App after updates constitutes acceptance of the revised Terms.

4. Eligibility

To use GlobalBuy24, you must:

  • Be at least 18 years old or the age of majority in your jurisdiction.
  • Have the legal capacity to enter into a binding agreement.
  • Use the platform in compliance with all applicable laws and regulations.

5. User Account

  • Registration: You may be required to create an account to access certain features. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.
  • Security: You are solely responsible for maintaining the confidentiality of your account credentials (username, password, etc.). You must take all reasonable steps to prevent unauthorized access to or use of your account. Notify us immediately at admin@globalbuy24.com if you suspect or become aware of any unauthorized access to or use of your account, or any other breach of security.
  • Prohibited Activities: You agree not to create accounts for fraudulent, deceptive, or malicious purposes, or to impersonate any other person or entity. Any such activity will result in immediate account termination and may lead to legal action.
  • Account Termination: GB24 reserves the right, at its sole discretion, to suspend or terminate any account that violates these Terms, engages in fraudulent activities, poses a security risk to the platform, or is deemed to be misused. This includes, but is not limited to, breach of any terms herein, providing false information, or engaging in any activity that harms the integrity or reputation of GB24 or its users.

6. How GB24 Works

  1. Placing an Order: Users provide product links from third-party online stores. GB24 processes the request and provides a comprehensive quote including the product price, our service fee, and the estimated shipping cost to the final destination.
  2. Payment: Once the quote is confirmed and accepted by the user, full payment must be made before GB24 places the order with the third-party retailer. Payments are processed via secure third-party payment providers as detailed in Section 7.
  3. Shipping to GB24 Hub: The items are purchased and delivered from the original online store to our designated Berlin hub in Germany. Users are responsible for ensuring the retailer can ship to this address.
  4. Processing & Shipping: Once received at our Berlin hub, we conduct an external package condition check, consolidate shipments (if multiple items are ordered), and then arrange for onward shipping to the final destination in selected African countries.
  5. Delivery: Users collect their orders at pre-determined designated pick-up points or via local couriers where applicable in the destination country. Specific delivery instructions and pick-up point details will be communicated to the user.

7. Purchasing and Payments

  • Pricing: The total price presented to the user includes the product cost as listed by the third-party retailer, GlobalBuy24's service fees for facilitation, and all applicable shipping fees from Berlin to the final destination. Any additional charges such as customs duties or taxes are separate and detailed below.
  • Payments: All payments are processed securely through reputable third-party payment providers. By initiating a payment through our platform, you acknowledge and agree to comply with the terms and conditions, as well as the privacy policies, of these third-party payment providers. GlobalBuy24 does not store your full payment card details.
  • Customs & Duties: Users are solely responsible for any and all applicable taxes, import duties, customs fees, or other governmental charges levied by the destination country. These fees are not included in the initial quote and must be paid by the user upon arrival or collection of the goods, as required by local regulations. Failure to pay these fees may result in delays or confiscation of the order.
  • Refunds & Returns: Refunds and returns are primarily subject to the policies of the original third-party retailers from whom the products were purchased. While GB24 will assist in facilitating communication and processing requests with these retailers on your behalf, the ultimate outcome (e.g., approval of refund, acceptance of return) cannot be guaranteed by GB24. Please refer to our detailed Cancellation & Refunds Policy below.

8. Shipping and Delivery

  • Delivery Locations: GB24 exclusively ships orders from our Berlin, Germany hub to pre-designated African destinations as specified on our platform. We do not offer shipping to other locations.
  • Item Eligibility: It is the user's sole responsibility to ensure that the chosen items can be legally and logistically shipped from the third-party retailer to our Berlin hub before placing a purchase order. GB24 is not responsible for items that cannot be delivered to our Berlin hub.
  • Packaging & Condition Check: Upon receipt at our Berlin hub, GB24 performs an external visual check of the package condition to identify any obvious signs of damage or tampering. However, we do not open sealed packages or verify the internal product quality, authenticity, or functionality.
  • Risk of Loss: The risk of loss or damage to items transfers from GB24 to the user once the items arrive at their final designated pick-up point or are handed over to the local courier for final delivery in the destination country.
  • Delivery Delays: GB24 is not liable for delays in delivery caused by factors beyond our reasonable control, including but not limited to customs clearance procedures, unforeseen carrier issues, natural disasters, political unrest, strikes, or other force majeure events. We will, however, endeavor to keep users informed of any significant delays.

9. Important Shipping Rules

  • Weight Limit: The maximum weight per individual item is 23 kg. Items exceeding this weight may be subject to additional fees, rejection, or require special arrangements.
  • Size Restrictions: Individual packages must not exceed 50 cm in width, 50 cm in length, and 50 cm in height. All items must fit within standard international shipping guidelines. Oversized items may incur additional charges or be rejected.
  • Prohibited Items: GB24 strictly prohibits the shipment of hazardous materials, perishable goods, illegal substances, weapons, explosives, or any other items restricted or prohibited by international shipping regulations or the laws of Germany or the destination country. For a comprehensive and updated list of prohibited items, please refer to our Prohibited Items List. It is the user's responsibility to review this list before placing an order.

10. Cancellations & Refunds Policy

This section outlines the specific conditions under which cancellations and refunds may be processed for orders placed through GlobalBuy24.

  • Order Cancellation by User: Orders cannot be cancelled once they have been packaged and shipped from our Berlin hub to Africa. If an order has not yet been processed by GB24 (i.e., not yet purchased from the retailer or not yet shipped from Berlin), users may request a cancellation. Such cancellations may be subject to a cancellation fee to cover administrative costs and any non-recoverable expenses incurred by GB24 (e.g., payment processing fees). The exact fee will be communicated upon cancellation request.
  • No Refunds After Shipment (with exceptions): Generally, refunds are not allowed once orders have been packaged and shipped from our Berlin hub. However, exceptions apply as detailed below. If an item is lost in transit or significantly delayed beyond reasonable expectations due to issues with the shipping provider (and not due to customs or user-related delays), users may contact GB24 for assistance in filing claims with the shipping provider. The outcome of such claims is subject to the shipping provider's policies.
  • Retailer Cancellations: If the original third-party retailer cancels an order for any reason (e.g., out of stock, payment issue on their end), we will issue a full refund to the user for the product cost, including any service fees charged by GB24 for that specific product. In such cases, users will be notified immediately by GB24, and refunds will be processed within 7 business days from the date of the retailer's cancellation confirmation.
  • Exceptional Cases (Damaged Upon Arrival): If an order is visibly damaged upon arrival at the final designated pick-up point or upon receipt via local courier, users must report the issue to GB24 within 48 hours of receipt. This report must include clear photographic evidence of the damage to the package and/or product. GB24 will then initiate an investigation with the shipping provider and/or retailer. Refunds or compensation for damaged items will be determined on a case-by-case basis, taking into account the extent of the damage, the investigation findings, and the policies of the relevant shipping provider and retailer.

11. Disclaimers and No Warranties

GlobalBuy24 acts solely as an e-commerce facilitator. We do not sell any products directly; rather, we assist users in purchasing items from third-party online retailers. Therefore:

  • No Product Guarantees: GB24 does not manufacture, endorse, or guarantee the quality, authenticity, fitness for a particular purpose, merchantability, or any other aspect of the products purchased from third-party retailers. Users must verify all product details, specifications, and authenticity directly with the original retailer before placing an order.
  • "As Is" and "As Available" Basis: The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
  • No Liability for Third-Party Content: GB24 is not responsible for the content, accuracy, or availability of third-party websites or product listings. Any issues arising from product descriptions, images, or availability on external retailer sites are solely between the user and the respective retailer.

12. Acceptable Use

You agree to use GlobalBuy24 only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service. You are strictly prohibited from:

  • Violating any applicable local, national, or international laws or regulations.
  • Using the platform for any fraudulent, deceptive, or misleading activities, including but not limited to misrepresenting your identity or payment information.
  • Uploading, posting, transmitting, or otherwise distributing any content that is harmful, malicious, unlawful, obscene, defamatory, threatening, harassing, abusive, or otherwise objectionable.
  • Interfering with or disrupting the integrity or performance of the Service or the data contained therein.
  • Attempting to gain unauthorized access to the Service or its related systems or networks.
  • Engaging in any activity that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service.

13. Intellectual Property

  • GB24 Ownership: All rights, title, and interest in and to the GlobalBuy24 App, its content (excluding user-submitted content), features, functionality, trademarks, logos, and service marks belong exclusively to GlobalBuy24 or its licensors. These are protected by copyright, trademark, and other intellectual property laws.
  • User Content License: By submitting reviews, comments, feedback, or any other content ("User Content") to GlobalBuy24, you grant GB24 a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media for the purpose of operating, improving, and promoting the Service. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to grant this license.

14. Privacy Policy

15. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company, its Affiliates, or their respective directors, employees, agents, or licensors be liable for any indirect, incidental, special, punitive, or consequential damages whatsoever, including, but not limited to, damages for loss of profits, loss of data or other information, business interruption, personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms.

Without prejudice to the foregoing, the Company's total liability to You for all damages, losses, and causes of action (whether in contract, tort, including negligence, or otherwise) arising out of or in connection with these Terms or Your use of the Service shall in no event exceed the amount paid by You to GB24 for the specific service giving rise to the claim in the twelve (12) months preceding the event giving rise to the liability, or [INSERT SPECIFIC MONETARY CAP, e.g., 100 EUR], whichever is lower. This limitation applies even if the Company has been advised of the possibility of such damages.

GB24 is not liable for:

  • Issues with product quality, authenticity, availability, or incorrect listings from third-party retailers.
  • Delays or failures caused by logistics providers, payment processors, or customs authorities.
  • Any direct or indirect damages arising from your reliance on information or products obtained through third-party links or services.

16. Indemnification

You agree to defend, indemnify, and hold harmless GlobalBuy24, its Affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, your use of any information obtained from the Service, and your use of any third-party services accessed through the App.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by GlobalBuy24 on the Service, constitute the entire agreement between you and GlobalBuy24 concerning the Service. This agreement supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Service.

19. Force Majeure

GlobalBuy24 shall not be liable for any delay or failure to perform its obligations hereunder if such delay or failure is caused by an event beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

20. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Cameroon, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be instituted exclusively in the courts located in Cameroon.

Important Note: While these Terms specify Cameroonian law as governing, users residing outside Cameroon (e.g., in the EU/Germany) may still benefit from mandatory consumer protection laws in their country of residence. We strongly advise you to consult with legal counsel to understand the full implications of this clause in your specific jurisdiction.
